PALESTINE, Texas (TXAN 24 News) — A judge in East Texas has upheld the execution warrant for Robert Roberson, a Palestine man on death row since 2003 for the death of his 2-year-old daughter. Roberson, 59, maintains his innocence and is set for execution on Thursday, October 17, despite widespread support for his release.
On Tuesday, Judge Alfonso Charles denied motions to vacate the warrant and to recuse retired Judge Deborah Oakes Evans, who issued the warrant. Roberson’s defense argued that Evans failed to follow proper procedure for retired judges, making her actions invalid.
Advocates, including scientists, attorneys, and Texas representatives, argue Roberson was wrongfully convicted. Brian Wharton, the lead detective in the original case, is now among those calling for clemency.
“I will forever be haunted by the role I played,” Wharton said. “It’s not too late for Texas to stop this execution.”
Supporters plan to rally at the Anderson County Courthouse following the decision, urging Governor Greg Abbott and the state’s parole board to intervene.
