Delays in Toxicology Reports Slow Justice for Texas Crash Victims

ELKHART, Texas (TXAN 24) – A fatal crash on March 5, 2025, has left a Texas family searching for answers and justice as they wait on toxicology results that could take up to a year to process.


The crash, which occurred on FM 2419 near Elkhart, claimed the life of man by the name of Coby, a passenger in a work truck that was struck by another vehicle.


According to the official crash report and statements from law enforcement, the driver of the other vehicle admitted to using cocaine two days before the crash and was operating the vehicle on a restricted license that required a licensed adult passenger over 21—yet he was alone.


Additionally, a witness reported that the driver had run another vehicle off the road prior to the fatal collision.


Despite these details, the driver was neither arrested nor cited at the scene, and the investigation remains ongoing. Blood samples were taken and sent to the Texas Department of Public Safety (DPS) Crime Lab in Austin, but officials say the results could take anywhere from six months to a year to be processed.


The delay in toxicology results is a growing concern in Texas, where families of crash victims are often left waiting for justice. Without confirmed results, law enforcement agencies are limited in pursuing charges, leaving victims’ families frustrated.


Coby’s family, along with the family of the injured driver, is demanding accountability—not just for the driver but also for the vehicle owner and the handling of the case by authorities.


“My son will never get to be a father, never get to marry the love of his life. His child will grow up never knowing him,” said Coby’s grieving parent. “Meanwhile, the driver is free, waiting on a lab report that could take a year.”

This case highlights a larger issue: the time it takes for toxicology reports to be processed in fatal crashes. Advocates are calling for reforms that would prioritize these cases and speed up forensic testing to prevent justice from being delayed.


Coby’s family is now urging national media outlets to bring attention to the case, believing increased exposure could help expedite the lab results and push for greater accountability in cases like this.
